While the primary concern is always to make certain that everyone is safe, once that has been accomplished, the added financial protection is the next most important thing.

Betsy Montgomery, drove the same car on her 55th birthday that she drove as a 15-year-old living in south Jackson, Mississippi — a 1966 red Mustang that her dad bought from the original owner in 1973.

How she got the opportunity to do so is a head-scratching story with a fairy tale ending.

“If I wasn’t friends with her and saw it for myself, I’m not sure I’d believe it,” says Mitch Thomas, 53, a Franklin County resident who has known Montgomery for more than 30 years.

On Oct. 19, 2012, a man from California left a message on Montgomery’s home phone near Brookhaven. The man said he wanted to talk to her about “some stolen property.”

Montgomery returned his call the next day. He identified himself as Lou Koven with something called the NICB.

“Have you had anything stolen?” he asked.

“No, nothing,” she said. “Well … except a car about 20 years ago.”

“What kind of car?” he asked.

“A 1966 red Mustang,” she answered.

“Well, I have it sitting right here in California. It was about to be put on a boat to Australia where somebody bought it,” he said.

Montgomery, 56, has worked as an emergency room nurse at St. Dominic Hospital in Jackson for most of her 40 years there. She isn’t shocked easily. But for several minutes after learning her Mustang was alive and well, Montgomery sat speechles…………… continues on Insurance Journal

The Coast Guard cited the owner of a boat that they rescued, after discovering expired flares on the 19-foot Boston Whaler.

Four people were on board the boat, which suffered an engine failure 12 miles northeast of Kaneohe Bay Monday afternoon.

The boater who reportedly crashed into their loved ones is not facing charges, suing him is pointless and the medical bills are mounting.

“It all falls on us,” Tonia Foster said.

Foster’s father, Gary McIninch, was killed on Lake Eufaula on July 4 in a hit-and-run collision.

Two of Foster’s daughters were injured and had to be flown to the hospital. The youngest cut up her head and needed stitches. The middle daughter broke her leg, so she had to have rods inserted and learn how to walk again.

Now nearly $ 200,000 later, Foster feels like the man who caused everything is getting off free – financially and criminally.

“It’s very hard to stay so strong for my children whenever I just want to sit there and have them hold me,” Foster explained.

— With temperatures rising after record lows across much of the nation, Boat Owners Association of The United States says it is a good time to check on your boat in winter storage.H

Here are five tips to ensure old man winter is kept at bay:

1. How low can she go? If your boat is stored in the water during the winter, are all of the above-water thru-hulls still above the waterline? The weight of snow and ice can submerge above-waterline thru-hulls, including the exhaust (inboard boats), so start shoveling if you notice she’s sitting lower in the water – plastic shovels and brooms are best. It’s also a good time to check on your bubbler system.

2. Call me shifty: For boats stored on trailers, jackstands or cradles, ensure the boat hasn’t shifted. Boats on stands/cradles should be level, while those on trailers should be slightly bow up. Boats more than 26 feet should have at least three jackstands per side, with plywood under each if the boat is on dirt or gravel – check to see they haven’t moved and are chained together to prevent them from being pushed away from the boat. You know the stands are in the right place when there is no hull deformation at the point of contact. If you see any problems with a jackstand, don’t try to adjust it yourself; contact marina staff.

AN eight-metre boat believed lost eight months ago after being capsized by a freak wave off Western Australia has been found 4000 nautical miles away, washed up on an island off the coast of Madagascar.

Perth-based owner Stephen Knight had already been paid insurance for the loss of the $ 200,000 LeisureCat vessel, which was swept away in the waters off Exmouth last May.

Mr Knight and a friend were on board the boat when the wave knocked them into the water and forced them to swim to a nearby island to seek rescue.

Despite four days of air searches, the boat could not be found and was declared lost.

But today, Mr Knight was contacted by the Rescue Coordination Centre in Canberra, which had been called by French officials who discovered the boat on rocks on Mayotte, between Mozambique and Madagascar.

That is a journey of more than 4000 nautical miles through numerous shipping lanes.

“I thought it might have hit to the coast of WA somewhere – so to hear it has gone so far away on another continent … it is a bit surreal,” Mr Knight said.

“I was in total shock.”

Despite floating upside down for the duration of the journey, the vessel appears reasonably intact.

JACKSONVILLE, Fla. — Acting United States Attorney A. Lee Bentley, III announced a grand jury returned five indictments charging seven men with conspiracy to commit mail and wire fraud.

The men charged are 46-year-old John J. Kurant, Jr., of St. Augustine, 34-year-old Adam Horvit, of Parkland, and 35-year-old Christopher E. Labaire, 47-year-old Greg Wilson, 36-year-old Jerold Wolfe, 47-year-old John Grant, and 45-year-old Scott Coleman all from Jupiter.  They each face a maximum penalty of 20 years in federal prison if convicted.

The Department of Justice says the indictments of Kurant and Labaire cite that Boat U.S. paid out $ 853,758.33 in insurance proceeds based upon the sham and fraudulent marine insurance claims.

The DOJ says the scam, worked by Kurant, a claims adjuster for Boat U.S., partnering with Labaire, defrauded their marine insurance program by creating and submitting fake insurance policies and claims.  The claims included the other men as pleasure boat owners who experienced ‘total losses’ including theft, damage, or sinking.  When the boat insurance claims were paid, the DOJ alleges the seven men shared the money.

The case was investigated by the FBI, Florida Department of Financial Services and Division of Insurance Fraud. It will be prosecuted by Assistant United States Attorney Mark B. Devereaux.
